Bien Yapı Ürünleri Sanayi Turizm ve Ticaret Anonim Şirketi; (‘'Bien'' veya ‘'Şirket ‘') tarafından 6698 Sayılı Kişisel Verilerin Korunması Kanunu (Kanun veya KVKK) kapsamında düzenlenen Kişisel Verilerin İşlenmesi Aydınlatma Metni' ni okudum, anladım. İşbu Aydınlatma Metni aracılığıyla işlenen kişisel verilerim, kişisel verilerimin işlenme amacı, toplanma yöntemi ve hukuki gerekçesi, işlenen kişisel verilerimin hangi amaçlarla kimlere aktarılabileceği ve veri sahibi olarak Kanun'dan doğan haklarıma ilişkin bilgilendirildim.
Referans olarak beyan ettiğim kişilere ait kişisel verileri, gerekli bilgilendirmeler dâhilinde açık rızalarını alınarak Şirket ile paylaştığımı kabul, beyan ve taahhüt ederim.
Açık rıza vermem durumunda rızamı dilediğim zaman hiçbir gerekçe göstermeksizin geri alabileceğim hususunda bilgilendirildiğimi kabul ve beyan ederim.
Kişisel verilerimin Şirket tarafından başvurumun değerlendirilmesi ve gelecekte ortaya çıkabilecek uygun bir pozisyon oluşması durumunda tarafımla iletişime geçilebilmesi amacıyla 1(bir) yıl süre ile muhafaza edilmesine, referanslarımın kontrol edilmesi ve gerekli araştırmaların yapılmasına, başvuruya ilişkin tarafımla iletişime geçilebilmesi amacıyla grup şirketlerine, Şirket ile aralarında organik bağ bulunan ve/veya ortaklık yapıları benzer olan şirketlere aktarılmasına açık rızam olduğunu kabul ve beyan ederim.
Bien Yapı Ürünleri Sanayi Turizm ve Ticaret Anonim Şirketi; (‘'Bien'' veya ‘'Şirket ‘') kişisel verileri 6698 Sayılı Kişisel Verileri Koruma Kanunu'nu (‘'Kanun'') ve bu Kanun' a bağlı ikincil düzenlemeler ile Kişisel Verileri Koruma Kurulu Kararları ve ilgili diğer yasal mevzuatlarda emredilen sınırlar çerçevesinde işlemektedir. İşbu Aydınlatma Metni Veri Sorumlusu sıfatıyla Şirket tarafından, siz çalışan adaylarını paylaştığınız kişisel verilerin işlenmesi hakkında Kanun'un 10. maddesi gereğince aydınlatabilmek amacıyla düzenlenmiştir.
İŞLENEN KİŞİSEL VERİLER
Kimlik (ad soyad, doğum tarihi, yaş, ehliyet durumu, askerlik durumu), iletişim (adres, telefon numarası, e-posta adresi), görsel ve işitsel kayıtlar (fotoğraf), mesleki deneyim (öğrenim bilgileri, yabancı dil bilgisi, bilgisayar kullanma becerisi, iş deneyimleri), Finans (ücret beklentisi) kategorilerinde ve referans bilgilerinize ilişkin kişisel verileriniz işlenebilmektedir.
KİŞİSEL VERİLERİN İŞLENME AMACI VE HUKUKİ GEREKÇESİ
Kişisel verileriniz; özgeçmişinizin aranan pozisyona uygunluğunun değerlendirilmesi, referans araştırması yapılması, iş başvurunuz nedeniyle sizinle iletişime geçilmesi, işe alım süreçlerinin yürütülmesi, Şirketimiz insan kaynakları politikasının uygulanması amaçlarıyla Kanunun 5. Maddesi 2. Fıkrasının (b) sözleşmenin kurulması veya ifası için zorunlu olma ve (f) ilgili kişinin temel hak ve özgürlüklerine zarar vermemek kaydıyla, veri sorumlusunun meşru menfaatleri için veri işlenmesinin zorunlu olması veri işleme şartları kapsamında işlenebilmektedir.
KİŞİSEL VERİLERİ TOPLAMA YÖNTEMİ
Kişisel verileriniz özgeçmişlerinizi Şirketimiz' e elden teslim etmeniz, e-posta aracılığıyla iletmeniz, internet sitesinde yer alan formunu doldurmanız vb. tamamen veya kısmen otomatik ya da otomatik olmayan yollarla yazılı, sözlü, elektronik veya diğer yöntemlerle toplanabilmektedir.
KİŞİSEL VERİLERİN KİMLERE VE HANGİ AMAÇLA AKTARILABİLECEĞİ
Kişisel verileriniz, iş başvurunuzun değerlendirilmesi ve başvurunuz nedeniyle tarafınızla iletişime geçilebilmesi amacıyla grup şirketlerimize, Şirketimiz ile aralarında organik bağ bulunan ve/veya ortaklık yapıları benzer olan diğer şirketlerimize aktarılabilecektir. Ayrıca iş başvurunuzun değerlendirilmesi sürecinde gerekmesi ve talep edilmesi halinde yasal yükümlülüklerin yerine getirilmesi amacıyla kanunen yetkili kamu kurum ve kuruluşları ile paylaşılması mümkündür.
KİŞİSEL VERİLERİN SAKLANMA SÜRESİ
Kişisel verileriniz başvurunuzun değerlendirilmesi ve gelecekte ortaya çıkabilecek uygun bir pozisyon oluşması durumunda tarafınızla iletişime geçilebilmesi amacıyla 1(bir) yıl süre ile muhafaza edilir. Başvurunuzun kabul edilerek Şirket ile iş ilişkisi kurmanız durumunda elde kişisel verileriniz özlük dosyanıza aktarılacaktır. Bu hususta Çalışan Aydınlatma Metni ile bilgilendirileceksiniz. Belirlenen saklama sürelerinin sonunda periyodik imha sürelerine uygun olarak belirlenen imha yöntemleri (silme ve/veya yok etme ve/veya anonimleştirme) ile imha edilmektedir.
Referans olarak paylaştığınız kişileri bilgilendirme ve onayları alma sorumluluğu tarafınıza aittir.
VERİ SAHİBİ OLARAK HAKLARINIZ
Şirketimize başvurarak kişisel verilerinizin işlenip işlenmediğini öğrenme, kişisel verileriniz işlenmişse buna ilişkin bilgi talep etme, kişisel verilerinizin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme, yurt içinde veya yurt dışında kişisel verilerinizin aktarıldığı üçüncü kişileri bilme, kişisel verilerinizin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme ve bu kapsamda yapılan işlemin kişisel verilerinizin aktarıldığı üçüncü kişilere bildirilmesini isteme, Kanun'a ve ilgili diğer kanun hükümlerine uygun olarak işlenmiş olmasına rağmen, işlenmesini gerektiren sebeplerin ortadan kalkması hâlinde kişisel verilerin silinmesini veya yok edilmesini isteme ve bu kapsamda yapılan işlemin kişisel verilerinizin aktarıldığı üçüncü kişilere bildirilmesini isteme, işlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle aleyhinize bir sonucun ortaya çıkması durumunda buna itiraz etme, kişisel verilerinizin kanuna aykırı olarak işlenmesi sebebiyle zarara uğramanız hâlinde zararın giderilmesini talep etme haklarınız mevcuttur. CLARIFICATION TEXT REGARDING THE SENDING OF COMMERCIAL ELECTRONIC COMMUNICATIONS
Qua Trading Ticaret Anonim Şirketi (“Qua Trading” or the “Company”) exercises due diligence in the protection of personal data. This Clarification Text has been prepared by Qua Trading, in its capacity as the Data Controller, in order to fulfill its obligation to inform under Article 10 of the Personal Data Protection Law No. 6698 (“Law”) and to inform data subjects about their rights listed in Article 11 of the Law.
1. Categories of Personal Data Processed and Purposes of Processing Your Personal Data
Your personal data within the categories of Identity (name, surname), Contact (e-mail address, phone number, address), Customer Transaction (order information, request information), Marketing (your preferences and habits regarding products and services, survey responses, information obtained through campaign activities), and Professional Experience (profession, company/position) may be processed by Qua Trading for the purposes listed below, provided that you give your explicit consent;
2. Methods and Legal Basis for Collecting Personal Data
Your personal data may be collected through verbal communication, paper, data collection forms, website, social media, phone, e-mail, and other electronic or non-electronic methods, and may be processed based on your explicit consent pursuant to Article 5/1 of the Law. If you give your explicit consent, you have the right to withdraw your consent at any time without providing any justification. You may also change your electronic communication preferences.
3. To Whom and For What Purposes Personal Data May Be Transferred
If you give your explicit consent, your personal data obtained may be transferred to relevant suppliers from whom service support is received, group companies, and other companies with which Qua Trading has organic ties and/or similar partnership structures, for the purpose of fulfilling the data processing purposes set forth in this Clarification Text.
4. Rights of the Data Subject Listed in Article 11 of the Law
Data subjects have the right to learn whether their personal data are processed, to request information if their personal data have been processed, to learn the purpose of processing their personal data and whether they are used in accordance with their purpose, to know the third parties to whom personal data are transferred, to request correction of their personal data if they are incomplete or incorrectly processed, to request deletion or destruction of their personal data in accordance with the legislation, to object to the emergence of a result against them through the analysis of their personal data, and to request compensation for damages in case of unlawful processing of their personal data. EXPLICIT CONSENT TEXT REGARDING THE SENDING OF COMMERCIAL ELECTRONIC COMMUNICATIONS
I have read and understood the Clarification Text Regarding the Sending of Commercial Electronic Communications prepared by Qua Trading Ticaret Anonim Şirketi (“Qua Trading” or the “Company”). Through this Clarification Text, I have been informed about my personal data processed, the purpose of processing my personal data, the method of collection and legal basis, to whom and for what purposes my personal data may be transferred, and my rights arising from the Law as a data subject.
I accept and declare that I have been informed that, in the event I give explicit consent, I may withdraw my consent at any time without providing any justification and may change my electronic communication preferences.
I accept and declare that I have shared my personal data with Qua Trading accurately and up to date, and that I will notify Qua Trading of any changes to this information within a reasonable time.
Commercial Electronic Communication Consent
I accept and declare that I give my explicit consent for my personal data within the categories of identity, contact, customer transaction, and marketing data; to be processed by Qua Trading for the purposes of conducting and managing customer relationship management (CRM) analyses, carrying out activities aimed at customer satisfaction, managing marketing processes related to Qua Trading’s products and services, analyzing customer habits and preferences to provide personalized offers, sending promotions, surveys, and e-newsletters of Qua Trading, and managing advertising, campaign, and promotion processes related to Qua Trading’s products and services; and for the purpose of sending commercial electronic communications (via SMS, e-mail, phone, etc.) within the scope of the Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages; and for my personal data to be transferred to relevant suppliers from whom service support is received, group companies, and companies with which Qua Trading has organic ties and/or similar partnership structures in order to fulfill these data processing purposes.
